Wyndham Vacation Rentals Reservation Terms, Charleston's Islands

1. AGENCY DISCLOSURE:
It is understood that each property is privately owned, including linens and furnishings, with Wyndham Vacation Rentals, Charleston (hereinafter referred to as "WVR") acting solely as Agent for the Owner. The Guest(s) agrees to compensate the Agent for any damages or excessive cleaning caused by their carelessness or negligence, including missing or damaged linens. WVR is not responsible for articles lost, stolen or left.

2. FINAL PAYMENT:
The Balance Due deadline is based on the type of property rented:
Villas, Condos and Cottages: Balance due 30 days prior to arrival.
Homes: Balance due 60 days prior to arrival.
Should WVR not receive the final balance by this due date, the Guest authorizes the Agent to charge the balance due on the reservation to the Guest's credit card on file. Guest payments earn interest and accrue to the benefit of the Guest. The Guest agrees that all interest from these payments shall go to WVR. Guest agrees that any accrued bonus points associated with WVR provided grocery discount cards go to the benefit of Wyndham Vacation Rentals.

3. TRAVEL PROTECTION:
Guests are offered Red Sky's Travel Protection for a premium amount based on their total stay price. We strongly recommend this benefit to protect you in case you have to cancel within the cancellation deadline. No refunds will be available from WVR for cancellations within the cancel deadline due to unforeseen circumstances such as illness, death, or Acts of God, including but not limited to mandatory hurricane evacuations, and the like. In order to be eligible for Travel Protection, the premium must be paid before the balance due date. Please see plan details for benefit information.

4. TOWN ORDINANCES:
Guest agrees to abide by the covenants of the Community Association and all Town ordinances. The Agent has the prerogative to terminate this agreement and ask violators to vacate. No refund will be given for the time remaining in their reservation. Occupancy and use of the premises and communal areas shall not be such as to disturb or offend Guests or Residents (e.g. guests may not hang articles from windows or balconies, bikes will be stored in designated areas, etc.). NO HOUSE PARTIES ARE PERMITTED. Guest(s) agrees not to smoke inside rental properties or other designated non-smoking areas.

5. OCCUPANCY:
The Guest(s) acknowledges and understands that he (she) is a licensee of the Owner and not a tenant; and is not acquiring any interest in the property. The Guest(s) acknowledges and understands this reservation may not exceed the allowed number of guests for the property booked, and confirms that the responsible adult occupying the property is 25 years of age or older. Violators will be asked to leave and will not be refunded any money for the time remaining in their reservation. At WVR, we make every effort to ensure that you get the exact property you request. If circumstances beyond our control prevent us from honoring your specific request, we will transfer your reservation to a comparable unit. If a suitable, comparable property cannot be located, a full refund will be issued.

6. MAINTENANCE:
Guest(s) agree that WVR or its agents or employees may enter the premises for the purposes of effecting necessary repairs and/or maintenance or for other necessary purposes. All reasonable efforts will be made to handle maintenance emergencies; however, no guarantee can be made that such problems can be resolved immediately. Please notify our office of any maintenance needs during your stay so repairs can be scheduled. No refunds will be made for mechanical failures.

7. CHECK-IN:
The Guest(s) acknowledges and understands that check-in is no earlier than 4:00 PM. Due to our high standards for cleanliness, not all units will be ready for check-in promptly at 4:00. Keys to accommodations will not be dispensed until the property has been prepared for arrival (generally between 4:00 pm and 6:00 pm). Guests checking-in after our Front Desk closes will pick up their Check-In Packet via a lockbox, located just outside the building. Lockboxes can be pre-arranged if you plan to arrive after hours.

8. CHECK-OUT:
Check-out is no later than 10:00 AM. The Guest(s) agrees to return all keys to WVR's front desk upon departure. There will be no refund for early departures for any reason, weather related or otherwise. Please refer to Red Sky Travel Protection coverage which may cover certain unforeseen circumstances relating to early departures.

9. PARKING:
Guest acknowledges car passes are limited per property. Please check the first page of the confirmation letter to see the maximum allowed vehicles at the property you are renting before you leave home. Villas have a 1 or 2-car maximum limit; private homes may allow more. (Wild Dunes, Seabrook & Kiawah - Motorcycles, campers, boats, trailers and RVs are not allowed in the gated Resort areas).

10. PETS:
Pets are strictly prohibited inside and outside the premises unless in designated “pet friendly” properties with prior approval and registration. If a pet is found inside or on the premises of a rental property without prior authorization, Guest will be asked to leave with no refund of the unused nights, and the reservation will be subject to applicable fines and penalties. Pet Friendly properties are limited to dogs only. If renting a ‘pet friendly’ property with the intent on bringing your dog, you must return a signed PET POLICY letter and pay the nonrefundable pet fee prior to check-in.

11. KIAWAH ISLAND POOL ACCESS:
Kiawah does not offer a public pool for general guest use. Private and community pools are restricted to the use of guests staying in those particular accommodations. If pool access is important to you, please verify the access associated with the accommodation you have rented. Most accommodations on Kiawah do not offer access to a swimming pool.

12. SEABROOK ISLAND CLUB ACCESS:
For access to the Seabrook Island Resort Club facilities, including two oceanfront swimming pools, kiddie pool, tennis courts, recreation programs, golf, restaurants and fitness center, guests must rent a property on Seabrook Island which offers Club access. Advanced reservations may be required; additional usage fees may apply. Please remember, as a guest at a private club, certain dress and decorum rules apply.

13. WILD DUNES SPORTSCARD ACCESS:
To access the Wild Dunes Sports complex, which includes a swimming pool, tennis courts, recreation programs and fitness center, guests must rent a property which offers a Sportscard. Access may require advance reservations and additional fees may apply.

14. POOL/HOT TUB/DOCKS:
In cases of accommodations with pools, hot tubs, and/or docks, the Guest agrees to use them at their own risk and to hold the Owner/Agent harmless from liability.

15. ELEVATORS:
In cases of accommodations with elevators, the Guest agrees that they are to be used for transport only. Parents are to monitor children's use. Guest(s) is responsible for any damage caused by abusive use.

16. INDEMNIFICATION AND PERSONAL PROPERTY:
Guest agrees to indemnify and hold harmless Wyndham Vacation Rentals and its employees and vendors free from any claim or liability related to or in connection with the rental of the dwelling. Please take care in securing your personal property at your accommodations. Neither Wyndham Vacation Rentals nor the property owner will be held liable for missing or stolen items. If either Wyndham Vacation Rentals or the property owner commences any proceedings to interpret or enforce any of the provisions of this Agreement (including the recovery of damages resulting from the acts or omissions of Guest), in addition to any other relief awarded by the court, the prevailing party shall be awarded its reasonable attorney’s fees, costs and expenses incurred in such proceedings.

17. INTERNET:
Please be aware that Internet services are not guaranteed to be provided in all rental properties managed by WVR. If access to the internet during your stay is important to you, please be sure to request a property that offers this at the time of booking. The internet access status of the property you have rented is noted on page one (1) of the Confirmation Letter. Rental guest acknowledges and agrees that use of Wi-Fi/Internet services at the rental property (“Services”) is for personal use and agrees not to use the Services in a manner prohibited by any federal or state law or regulation. Transmission or download of any material in violation of federal or state law or regulation, including, but not limited to any copyrighted material, material protected by a trade secret or material or messages that are unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable in any manner or nature or that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation, is prohibited. Rental guest acknowledges that there is content on the Internet or otherwise available through the Services which may be offensive, or which may not be in compliance with all local laws, regulations and other rules. Rental agent and the rental property owner assume no responsibility for and exercises no control over the content contained on the Internet or is otherwise available through the Services. All content accessed or received by the rental guest (or an invitee of rental guest) is used by rental guest at his or her own risk, and Rental agent, Rental agent’s affiliates and their respective officers, managers, agents and employees and the rental property owner shall have no liability resulting from the access or use of such content by the rental guest. In the event that Rental agent or the rental property owner receives a copyright infringement notice from a copyright holder and/or an internet service provider, which includes a date and time of the alleged infringement that occurred during your rental stay, rental agent, in rental agent’s discretion, may reveal your identity (name, address and telephone number) to the copyright holder and/or internet service provider or otherwise disclose your identity as required by subpoena or other court document.

18. CANCELLATION:
Cancellation deadlines are based on the type of property rented: Villas, Condos and Cottages: Cancellations received within 30 days of arrival will forfeit all payments made. Homes: Cancellations received within 60 days of arrival will forfeit all payments made. Cancellation received within 72 hours of booking will incur no penalty if booked outside of the cancellation deadline. After 72 hours have passed, cancellations are subject to a non-refundable $50 Processing Fee. If booked within the cancellation deadline, Guest has 24 hours from the time of booking to cancel with no penalty.
