Wyndham Vacation Rentals Reservation Terms, Myrtle Beach

 

Please take a moment to read the following important information. It will be helpful when booking a reservation with Wyndham Vacation Rentals. These terms and conditions govern all short-term rentals by Wyndham Vacation Rentals in Myrtle Beach (“Agent”). Any breach of the terms and conditions may result in immediate eviction of the guest and all occupants with forfeiture of the full lease payment.

The term “guest(s),” “occupant(s)” or “tenant(s)” as used in this rental agreement includes the registered guest and all other persons who occupy the vacation rental unit.

A Wyndham Vacation Rentals reservation agent will contact the guest within 48 hours to confirm details of any online booking. A signed rental agreement will be required for all online bookings to confirm the reservation.

By booking a reservation with Wyndham Vacation Rentals, guest agrees to all terms and conditions and agrees to follow rules and regulations specific to the property rented. Guest agrees that the property will be used only as a private dwelling and only for the use of the guest named on the reservation. Occupants, visitors and all people at the unit with permission of the above agree to abide by the Rules and Regulations of the community in which they are staying.

Payment Schedule
If all Deposit or Balance Due payments are not received by the due dates given on guest’s Confirmation, the reservation will be considered cancelled under the terms and conditions provided herein and are subject to deposit and cancellation policies.

Payment by guest or guest's agent constitutes acceptance and confirmation by the guest and guest's agent of the deposit and cancellation and use policies, restrictions, and additional information given in the rental agreement. If a credit card is used by guest or guest's agent for advance deposits or payments, guests and guest's agent hereby agree to have the advance deposits and payments listed in the guest's confirmation charged to the credit card and further agree that said amounts shall be subject to the deposit and cancellation policies given in the rental agreement. Any changes in the deposit and cancellation and use policies are effective only if executed in writing by an officer or the General Manager of Myrtle Beach Vacation Rentals.

Rates
Rates, fees and taxes are subject to change without notice. The daily rate may include amenity fees to cover use of certain amenities at the property. Higher rates apply to houses and holiday periods such as Easter, Independence Day, Thanksgiving and Christmas. Monthly rates are available at many properties on a seasonal basis; please call for specific details.

The Wyndham Vacation Rentals website automatically applies the current best available rate. If a stay is eligible for the current best rate, the price quote already has the discount applied. A guest may enter a promotion code in the PROMO CODE field when booking. No further discounts will be applied after booking.

Advance Deposits
At time of booking, a credit card advance deposit is required for the following:

  • Fifty percent (50%) of the total rental amount before tax,

  • Administrative fee plus tax

  • Amenity fee, and

  • Full payment of Vacation Rental Insurance and tax, if purchased.

Reservations made within 30 days of arrival require full payment at time of booking.

Larger homes and monthly stays have different minimum-stay requirements, advance reservation, advance payment and cancellation policies. These will be reviewed at the time of reservation and confirmation.

Advance deposit payments are non-refundable. Wyndham Vacation Rentals recommends that guests purchase Vacation Rental Insurance in case travel plans change.

Final Payment
Final payment is due 30 days prior to arrival. Reservations made on or after the final payment due date require full payment at time of booking. If payment is not received by the final payment due date, Agent is authorized to charge the remaining balance to the credit card on file for the reservation.

The final payment will include the following:

  • Remaining rental balance,

  • All other taxes, and

  • Other charges (e.g. pool heating, additional housekeeping, etc.).

Methods of Payment
The Agent accepts Visa, MasterCard, American Express and Discover credit cards. A credit card will be required at time of booking for all reservations.

Guest must present a credit card at check-in for incidentals and damagesGift cards and reloadable debit cards are not accepted for security.

Reservation Fee
All reservations include a non-refundable Administrative Fee to help cover the cost of bookings, front desk services and other value-added programs.. The fee is subject to state and local tax. The administrative fee applies to each reservation, even if multiple stays are booked simultaneously. The reservation fee is automatically added to the reservation and will appear as a separate line item in the guest’s folio.

Vacation Rental Insurance
Wyndham Vacation Rentals is pleased to offer optional travel insurance by Red Sky Travel Insurance to protect your vacation investment. Please ask your Reservation Professional for details.

Amenity Fee / Guest Fee
A mandatory amenity fee may be required on reservations at certain properties.

Clean Fee
A one-time departure clean fee covers the normal cleaning required after guest departure and enough linens and towels for the number of guests that the property can accommodate. Daily housekeeping services are not included with any reservations.

Incidentals & Damage Deposit
Guest must present a credit card at check-in for incidentals and damages Gift cards and reloadable debit cards are not accepted for security.

OTHER CHARGES

Late Checkout
Checkout time is before 10:00am. Departures after 10:00am will be subject to additional charges up to and including the full daily rent rate.

Telephone Use
Local calls are free, but all long distance calls must be charged to a telephone card, credit card or the guest’s home phone.

Smoking Policy
To preserve the condition of our properties, all Wyndham Vacation Rentals properties in Myrtle Beach are non-smoking. To cover the cleaning costs necessary to return the unit to its proper condition, a fine of no less than $200.00 will be added to the final bill for any unit in which Wyndham Vacation Rentals reasonably believes smoking has occurred during the guest’s stay. The amount of the fine will be determined by Wyndham Vacation Rentals. All common areas of our properties are smoke free, including hallways, lobbies, garages, and pool and hot tub areas. Guest agrees not to smoke inside rental units, on decks, patios or balconies, or in any other designated non-smoking area including public spaces and public beaches if ordinances or notices prohibit such activity.

Pet Policy
A limited number of dog-friendly homes are available. The only exception is for registered service animals. Dogs under 30lbs each are permitted in select properties, with pre-approval from Wyndham Vacation Rentals. There is a limit of two dogs per property. A non-refundable fee of $150 plus tax is required per dog.

Agent reserves the right to charge damages and/or penalty fees, or to evict a guest immediately, if the guest has a pet on the premises without the express written permission of Wyndham Vacation Rentals. Wyndham Vacation Rentals must have full knowledge of the pet at the time of booking.

Payments Received
Advance deposits or rental payments shall remain the property of and for the use of Wyndham Vacation Rentals, subject to stated cancellation policies, and any interest income or profit from advance deposits or rental payments belong solely to Wyndham Vacation Rentals.

Cancellation & Change Policy
Rental agreements may be terminated by Agent or guest at any time after satisfying any cancellation policies and complying with any laws that may apply. Guest shall not be relieved of any portion of their reservation due to weather, flight cancellations or any travel-related or other issues which may arise and which are not under control of the Agent; Wyndham Vacation Rentals recommends guests protect their travel investment with the purchase of Vacation Rental Insurance.

Any funds received by Wyndham Vacation Rentals under the rental agreement shall be applicable to cancellation policies. Any earnings derived from such funds while in the Agent’s possession shall belong to the Agent.

Deposits & Payments
If all Deposit or Balance Due payments are not received by the due dates given on guest’s confirmation, the reservation will be considered cancelled under the terms and conditions provided herein and subject to the following deposit and cancellation policies.

Cancellations
All cancellations must be in writing; this written notice must be received before Agent will attempt to re-rent the unit for the full time period at the same rate. Cancellations must have been issued a cancellation number to be valid. Advance deposit payments are non-refundable. Wyndham Vacation Rentals recommends that guests purchase Vacation Rental Insurance in case travel plans change.

Cancellations received prior to the final payment due date—greater than 30 days prior to arrival—will result in the following:

  • Forfeiture of advance deposit,

  • Forfeiture of administrative fee, and

  • Forfeiture of Vacation Rental Insurance premiums and tax, if purchased.

Cancellations received on or after the final payment due date are fully non-refundable.

No shows, late arrivals and early departures will be charged the full amount for the entire reserved stay.

Weather Events & Evacuation
In the event of a storm or hurricane, no refunds will be given unless the Governor of South Carolina orders mandatory evacuation of the exact area where the reserved property is located. In this instance, refunds will be issued only for nights that the evacuation order is in place. No refunds will be issued for cancellation prior to an official mandatory evacuation order or during a voluntary evacuation order. No refunds will be issued for cancellation of unused portions of vacation that are not used once the evacuation order is lifted.

Two-Party Occupancy
In the event two parties reserve or occupy a single unit and one party cancels, the other party is obligated for the standard occupancy rate.

Refunds
Because Wyndham Vacation Rentals carefully schedules reservations in advance, no partial refunds will be made for late arrivals or early departures. No refund will be given for early departures for any reason, weather related or not. Wyndham Vacation Rentals recommends that guests purchase Vacation Rental Insurance, which may cover certain unforeseen circumstances relating to early departures.

If a guest is due a refund, Wyndham Vacation Rentals will issue the refund no more than 30 days after the departure date of the original stay. Refunds are payable to the renter within 30 days after the subsequent re-rent payment has cleared the Agent’s account.

No Shows, Late Arrivals, Early Departures
Wyndham Vacation Rentals cannot refund any monies should a guest decide to shorten their stay. Guest is responsible for payment of all nights confirmed, regardless of guest’s late arrival or early departure date.

No shows, late arrivals and early departures will be charged the full amount for the entire reserved stay. For extended-stay rentals over 28 days, the booking becomes fully non-refundable 90 days prior to arrival.

If a guest wishes to stay longer, availability of lodging will determine if the guest’s stay can be extended at additional cost.

Unit Availability
Wyndham Vacation Rentals makes every effort to ensure that a guest gets the exact property requested. In the event that a property becomes unavailable for any reason, Agent will make every effort to transfer the reservation to a comparable or upgraded unit. All conditions of the rental agreement will transfer to the new property. If comparable accommodations are not available, Agent will be held harmless and the guest agrees that its only remedy shall be a full refund of any monies paid. If the property should become unavailable during occupancy and comparable accommodations are not available, Agent will be held harmless and guest agrees that its only remedy shall be a refund for the unused portion of their stay only.

No Warranties Made
Guest agrees that there are no warranties or guarantees on beach conditions or weather conditions.

Falsified Reservation
Any reservation obtained under false pretense will be subject to forfeiture of advance deposit payment and/or rental money and the party will not be permitted to check in.

Termination of Occupancy
Wyndham Vacation Rentals is committed to being a good neighbor and asks that guests be considerate of those that live nearby. Unfortunately, from time to time some occupants disturb their neighbors, by creating excessive noise, violating the no smoking policy or causing other nuisances. Agent expressly reserves the right to terminate, at any time, a guest’s occupancy, and to evict guest from the unit, in the event that complaints are lodged which indicate that guest is disturbing the neighbors. In such event, guest will also forfeit all monies previously paid to Wyndham Vacation Rentals.

State law forbids anyone under 21 years of age from consuming any beer, wine, distilled spirits, etc., including consumption at any private function. If a guest, visitor or anyone at the unit under the age of 21 years is consuming alcoholic beverages, said conduct is a breach of the lease and guest and all occupants shall vacate the property and forfeit the full reservation payment.

Maximum Occupancy
All properties are limited to the occupancy listed in the property description. Guest acknowledges and understands that he or she is a licensee of the Owner and not a tenant; and is not acquiring any interest in the property. Occupancy may not exceed set limits, including children. Over-occupancy will result in additional fees charged to the credit card on file for the reservation. If over-occupancy is considered in violation of any law or fire code, Wyndham Vacation Rentals will require guest to secure additional accommodations or vacate the property without refund.

Occupancy Restrictions
Occupants receive no interest in real property, but merely acquire a license to use the rental unit (subject) to the right of Wyndham Vacation Rentals to change accommodations up to and including the date of arrival. The term "occupant" or "occupants" as used in this rental agreement includes the registered guest and all other persons who occupy the rental unit.

The unit reserved under this confirmation is limited to adults and families. Sports team participants, and individuals 25 years of age or younger unaccompanied by their parents or legal guardians, are not allowed in these privately owned units. If the number of adults and children exceeds maximum allowed in this unit, if sports team participants, or if individuals age 25 or younger unaccompanied by their parent or legal guardian occupy this unit, it shall be cause for immediate termination of this occupancy without refund.

Restrictions may apply regarding the number of people that may accompany a parent or legal guardian. Additional restrictions may apply during the spring break vacation period. House parties are not allowed under any circumstances with or without supervision. Chaperoned groups are prohibited unless prior approval is given by the Group Sales Department.

Wyndham Vacation Rentals reserves the right to enter the property for any maintenance, cleaning or inspection purposes. As an Agent of the Landlord, we reserve the right to refuse rental, cancel future reservations or terminate occupancy without refund, if, in our opinion, the occupancy of the property is detrimental to the Landlord, our client.

Parking Restrictions
Parking is limited. No motorcycle, trailer, RV, boat, camper or bus parking is available at any property. No exceptions will be made to the maximum number or types of vehicles allowed. Prior to making a reservation, guest should ask the reservation agent about the parking regulations for their chosen property.

All condo reservations are limited to two (2) vehicles per unit. Two (2) parking passes will be issued at check-in. Vehicles without a parking pass are subject to be towed at owner's expense.

Parking at houses is limited to the number of vehicles that the property will accommodate. Parking on the grass or street is not allowed.

Age Restrictions & Conduct
The individual making the reservation and signing the rental agreement at check-in must be 25 years of age or older, must provide a major credit card, and must occupy the rental property the entire term of the reservation. The same individual agrees to supervise and be financially and legally responsible for all other guests occupying the property, specifically including those who are under 25 years of age. If this age provision is violated, reservation will be subject to immediate termination at the sole discretion of Wyndham Vacation Rentals, and all monies paid will be forfeited.

Any misrepresentation by the guest will be considered a violation of rental terms and conditions and the guest will be asked to vacate the rental property without refund. Wyndham Vacation Rentals reserves the right to require valid identification before allowing occupancy of the rental property.

Singles under 25 years of age are prohibited unless accompanied by parent or legal guardian. Restrictions may apply regarding the number of people that may accompany a parent or legal guardian. Additional restrictions may apply during the spring break vacation period. House parties are not allowed under any circumstances with or without supervision. Chaperoned groups are prohibited unless prior approval is given by the Group Sales Department.

Guests producing excessive noise and/or behavioral complaints are subject to eviction without refund. All costs incurred for property damage occurring as a result of intentional or illegal behavior will be charged, at the sole discretion of Wyndham Vacation Rentals, to the credit card on file for the reservation. Guest agrees not to move furniture; moving furniture will result in additional charges, at Agent's sole discretion, to the credit card on file for the reservation. Certain closets and cabinets in properties are kept locked and are for owner's use only.

Guest agrees to compensate Wyndham Vacation Rentals for any damages caused by their carelessness or negligence including missing or damaged linens.

ADDITIONAL TERMS & CONDITIONS

Check-In and Checkout Times
Check-in time is between 4:00pm and 6:00pm. Due to Wyndham Vacation Rentals’ high standards for cleanliness, all units may not be ready for check-in promptly at 4:00pm. Guests are encouraged to have alternate plans available between 4:00 and 6:00pm in case the unit is not yet ready.

Checkout time is before 10:00am. Departures after 10:00am will be subject to additional charges up to and including the full daily rent rate. No refund will be given for early departures for any reason, weather related or not. Wyndham Vacation Rentals recommends that guests purchase Vacation Rental Insurance, which may cover certain unforeseen circumstances relating to early departures.

Late Arrivals
Arrangements will be made for late arrivals. Guest should call during office hours for late-arrival instructions. Late arrivals and early departures will be charged the full amount for the entire reserved stay.

Late arrivals are required to come to the Agent’s office the following day to check-in and sign the required paperwork. If the guest fails to sign the paperwork, then by occupying the rental unit guest agrees to all terms and conditions.

Agent reserves the right to charge the credit card on file for any damages. Agent reserves the right to suspend access to the rental until such requirements are met.

Falsified Reservation
Any reservation obtained under false pretense will be subject to forfeiture of advance deposit payment and/or rental money and the party will not be permitted to check in.

Office Hours
Office hours are 9:00am to 6:00pm and will be extended for high-volume periods.

Reservations
Agent accepts reservations by phone and online. All rentals are on a nightly or weekly basis depending on the property. Minimum-stay requirements vary by property and season.

For all online bookings, guest will be contacted by a reservation agent to confirm reservation details. A signed rental agreement is required for all online bookings to confirm the guest’s reservation.

All minimum-night stay requirements must be met in order for reservation to be confirmed.

Monthly Rentals
Monthly rates may be available at select properties on a seasonal basis. Please call for specific details.

Larger homes and monthly stays have different minimum-stay requirements, advance reservation, advance payment and cancellation policies. These will be reviewed at the time of reservation and confirmation.

Monthly Priority
Three-month rentals or longer will be given priority during the winter rate structure period. Complimentary services and other packages are not included in monthly reservations.

As-Is Condition
Guest acknowledges acceptance of the unit in “as is” condition and waives the right to withhold rent or to be compensated in any way for any alleged deficiency.

Town Ordinances
Guest agrees to abide by the covenants of the Community Association and all Town Ordinances. The Agent reserves the right to terminate the rental agreement and ask violators of any law or ordinance to vacate the rental unit immediately without refund. Occupancy and use of the premises, common areas and public lands shall not be used as such to offend or disturb any other guest, resident or wildlife. Items such as towels, banners and flags may not be hung from balcony railings or windows or any other area visible from the exterior of the property. Fireworks are not allowed to be discharged from any Wyndham Vacation Rentals property and are illegal on all public beaches.

Alcohol is not allowed in any public place, visible or otherwise. State law forbids anyone under 21 years of age from consuming any beer, wine, distilled spirits, etc., including consumption at any private function. If any person under the age of 21 years is consuming alcoholic beverages, then said conduct is a breach of the lease and guest or occupants shall agree to and shall vacate the property and forfeit the full lease payment.

What to Bring
Guests are encouraged to bring beach or pool towels, as towels and linens are not permitted to be taken from the units, except to launder. Wyndham Vacation Rentals also recommends guests bring coffee filters, salt and pepper, spices, foil and any special food products, as well as personal items such as sunblock, shampoo, lotion and a hair dryer. Grocery delivery services can be arranged prior to arrival; please call for details.

Housekeeping
Housekeeping services are not included with any reservations.

Guest is not required to perform any housekeeping duties prior to departure. A one-time departure clean fee to cover the normal cleaning required after guest departure is included in the rental rate unless otherwise noted.

Linens & Supplies
A supply of linens and towels is included in the rental rate unless otherwise noted. Guest agrees to compensate Wyndham Vacation Rentals for any damages caused by their carelessness or negligence including missing or damaged linens. A starter supply of standard toiletries, dishwasher detergent and paper products such as toilet paper, tissues and paper towels is provided in each of our properties at check in. The starter supplies are not designed to last the length of your stay. They will give you time to settle in before making a trip to the store for additional supplies.

Unit Amenities
Due to local service conditions, Wyndham Vacation Rentals does not guarantee air conditioning, the appliances or availability of wifi in the rental unit. There is also no representation guaranteeing the operation of recreational facilities or scheduled recreational events. Courtesy items including but not limited to video game systems, telephone service, Internet access and game tables provided by the homeowner are not warranted or guaranteed. Bedding is not warranted as to the comfort.

Telephone Use
All units provide telephone service, but that service is not guaranteed. Local calls are free, but all long distance calls must be charged to a telephone card, credit card or the guest’s home phone.

Maintenance
Agent will make reasonable efforts to handle maintenance requests; however, no guarantee can be made that such problems can be resolved immediately. Guests shall notify the office of any maintenance needs during their stay so that repairs can be scheduled. No refunds or adjustments will be made due to maintenance issues or mechanical failures.

Only Agent may make any service calls to outside contractors. Any service ordered by the guest from an outside contractor will be the total responsibility of the guest, even if such services are determined, at a later date, to be needed. Guest may not refuse Agent, Landlord or outside contractor the right to enter the property to make reasonable repairs as determined by Wyndham Vacation Rentals.

Agency Disclosure
Wyndham Vacation Rentals serves as the Agent and representative of all owners of condominium units, townhomes and houses in its rental program and acts at all times in and for the best interests of the owners. Guest acknowledges that each property is privately owned, including linens and furnishings, with Wyndham Vacation Rentals acting solely as Agent for the owner.

Agent’s Right of Entry
Wyndham Vacation Rentals reserves the right to enter the property for any maintenance, cleaning or inspection purposes, or to show a property listed for sale. Guest may not refuse Agent, Landlord or outside contractor the right to enter the property to make reasonable repairs as determined by Wyndham Vacation Rentals.

Indemnification & Personal Property
Guest agrees to indemnify and hold harmless Wyndham Vacation Rentals and its related entities and their agents, employees and servants, and the Landlord, free from any claim or liability related to or in connection with the rental of the dwelling including but not limited to injuries, accidental or otherwise, that they have incurred or suffered on the premises for any causes whatsoever during the term of the reservation.

Guests should take care in securing personal property at their accommodations. Neither Wyndham Vacation Rentals nor the property owner will be held liable for missing or stolen items. Neither Wyndham Vacation Rentals nor the Landlord shall be liable for property left in the unit by the guest, even in the event the property left in the unit is picked up and returned by mail.

Units for Sale
In the event a property is listed for sale, Wyndham Vacation Rentals may find the need to show the property during a guest's visit. The Agent will make every effort to schedule the showing at a convenient time so as not to disturb the guest's vacation.

Errors & Omissions
Agent is not responsible for errors or omissions. Agent will make every effort to provide up-to-date and accurate information on its Web site and in any print advertising but will not assume any liability for errors. All information including rates and rental terms and conditions are subject to change at any time. Guest will receive confirmation via email or standard mail. It shall be the guest's responsibility to check for errors on the confirmation. Guest will not hold Agent liable for any reservation errors.

Rental/Lease Agreement
Guest is advised that making a reservation creates a tentative agreement to rent/lease accommodations with Wyndham Vacation Rentals. This will become a binding agreement once guest has been contacted by a rental representative and advised of a confirmation number, at which point the reservation is subject to all policies and procedures as set forth above.
